Sugar Free September (sugarfreeseptember.org.au) is a fundraising initiative owned and operated by Muscular Dystrophy NSW.

THE CHALLENGE

The Challenge starts on 1st September and ends on 30th September. Whist participating in this Challenge may have health benefits, Muscular Dystrophy Association of NSW provides no warranty whatsoever that this Challenge will achieve an individual's health goals. The Challenge has not been developed with any individual's particular health requirements in consideration.

Do not rely on the information provided in relation to the Sugar Free September Challenge as an alternative to medical advice from a doctor or other professional healthcare provider. If participants have any specific health or medical concerns, they should consult with their medical or healthcare provider, prior to changing their diet or nutrition regimen. 

While Muscular Dystrophy Association of NSW has made every attempt to ensure that the information provided as part of the Sugar Free September Challenge has been obtained from reliable sources, Muscular Dystrophy Association of NSW is not responsible for any errors or omissions, or for the results obtained from the use of this information.

GENERAL CHALLENGE TERMS & CONDITIONS

I acknowledge and agree to the following terms, conditions and disclaimers in relation to Sugar Free September:

1. My participation in Sugar Free September will be entirely of my own free will and at my own risk.

2. I will only participate in Sugar Free September if I am medically and physically fit to do so. If in any doubt, I will seek appropriate medical advice and will not participate if it is not recommended by my doctor.

3. I acknowledge that Sugar Free September and Muscular Dystrophy Association of NSW (and any of their representatives) are not providing medical or nutrition advice to me, or making any recommendation or representation to me as to the benefits of Sugar Free September. 

4. Any dietary change may involve risks, or may have consequences for individuals. I acknowledge that I will make my own enquiries, seek appropriate advice and make my own assessment as to those risks and consequences and the suitability for me of participation in Sugar Free September unless and until advised by my doctor.

5. I will consult my doctor immediately if I suffer any personal injury or illness or if I experience any unusual symptoms or reactions, and in those circumstances, I will stop any participation in Sugar Free September unless and until advised by my doctor.

6. If I encourage any other person to participate in Sugar Free September, I will draw their attention to these terms, conditions and disclaimers in relation to Sugar Free September.

7. I acknowledge that, to the maximum extent permitted by law, Sugar Free September and Muscular Dystrophy Association of NSW disclaim, and do not assume any duty, responsibility or liability to me for any loss or damage to my personal property, or injury to me or my death arising out of or in any manner whatsoever connected with my participation in, or any statements in relation to, or promotion of, Sugar Free
September by Muscular Dystrophy Association of NSW or Sugar Free September.

8. I release and discharge Sugar Free September and Muscular Dystrophy Association of NSW, to the maximum extent permitted by law, from:

i) All responsibility or liability arising from any act, omission, or neglect causing loss or damage to my personal property, or injury to me or my death; and

ii) All claims, suits, actions or proceedings or demands, costs, charges and liabilities now or in the future of whatsoever nature, arising out of or in relation to or in any manner whatsoever connected with my participation in, or any statements in relation to, or promotion of, Sugar Free September by MMuscular Dystrophy Association of NSW or Sugar Free September.

9. This document may (to the maximum extent permitted by law) be pleaded in any court as a bar to any action, suit, claim, cause of action or proceedings commenced or at any time to be commenced by me or by any person claiming through me or on my behalf against Sugar Free September and Muscular Dystrophy Association of NSW arising out of or in relation to or in any manner whatsoever connected with my participation in, or any statements in relation to, or promotion of, Sugar Free September by Muscular Dystrophy NSW or Sugar Free September.

NUTRITIONAL DISCLAIMER

I acknowledge and agree to the nutrititional disclaimers below in relation to Sugar Free September:   

1. Sugar Free September challenge is an online fundraiser and is not intended to be a diet program. You have the choice to either cut out a favourite sweet treat or all added sugars for the month of September, but ultimately it is up to each individual how much added sugar they remove from their diet during the challenge.

2. Natural whole foods such as fruits, vegetables, seeds and grains are highly encouraged throughout the Sugar Free September challenge.

3. Information provided in relation to Sugar Free September is not an alternative to medical advice from a doctor or professional healthcare providers. Never disregard professional medical advice or delay seeking it because of something you have read on this website.

4. Before making any significant changes to your diet or embarking on a specific nutrition plan, it is strongly recommended to consult with your doctor or a qualified healthcare professional. They can assess your specific needs, provide personalised guidance and support based on your requirements and medical history, and monitor any potential impacts on your health throughout the challenge.

5. Participants with specific health or medical concerns should consult with their medical or healthcare provider before making any changes to their diet or nutrition regimen.

6. Doctors or healthcare providers should be the primary source of information and guidance throughout the challenge.

7. The information provided on this Sugar Free September website and during the Sugar Free September challenge is general in nature and does not take into account an individual’s personal circumstances.

8. Whilst participating in Sugar Free September may have health benefits for some participants, Muscular Dystrophy Association of NSW provides no warranty whatsoever that this challenge will achieve an individual's health goals.

USER CONDUCT

You represent and warrant to us that you:

Health

1. Are in a good state of health to participate in Sugar Free September and have not been advised otherwise by a medical practitioner;
2. Will consult your doctor immediately if you suffer any personal injury, illness or any unusual symptoms or reactions, and in those circumstances, will stop participating in Sugar Free September;

Capacity 

1. Have the legal capacity to enter these terms;
2. Are 18 years of age or older. No person under the age of 18 may use sugarfreeseptember.org.au to donate or fundraise, with the exception of those who are 13 years or older and have provided parental permission.

Confidentiality

1. Will keep all passwords, account names, log in identifiers required to access www.sugarfreeseptember.org.au secure and confidential;

Behaviour

1. Will be solely responsible for all your activities on the sugarfreeseptember.org.au site, also referred to as the Site;

2. Will not use sugarfreeseptember.org.au in any way that causes, or is likely to cause, the site or access to it to be interrupted, damaged or impaired in any way;

3. Will not use the Site to misrepresent your identity or affiliation with any person or organisation;

4. Will not use the Site to conduct, display or forward details of any survey, contest, pyramid scheme or chain letter or use any part of our Site to send commercial messages in contradiction of the Spam Act 2003 (Cth)

5. Will not attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the site, any associated website or any other website;

6. Will not hide, deface, alter or delete any copyright symbol, trade mark or other proprietary rights notice; 

7. Will not use any part of the Site which you are not authorised to use or devise ways to circumvent security in order to access part of the Site which you are not authorised to access. This includes, but is not limited to, scanning networks with the intent to breach and/or evaluate security, whether or not the intrusion results in access; and

8. Will not use or attempt to use the Site for any unlawful, criminal or negligent purpose. This includes, but is not limited to, password cracking, social engineering (defrauding others into releasing their passwords), denial-of-service attacks, harmful and malicious destruction of data, infringing the intellectual property rights of any person, and injection of computer viruses and intentional invasion of privacy.

DISCLAIMER

Muscular Dystrophy Association of NSW reserves the right to withdraw approval to fundraise should it be necessary to protect its reputation.

PRIVACY

Muscular Dystrophy Association of NSW respects and is committed to protecting the privacy of the people whose personal information it collects. By participating, you have agreed that Muscular Dystrophy Association of NSW may collect, use and disclose your personal information to carry out the functions and activities of Muscular Dystrophy Association of NSW including to process donations, to comply with our legal obligations, to recruit, train and manage our people, to maintain and update our records and to help us manage and provide our services. Unless you ask us not to, we may also use your information to ask for your support and to keep you informed about the wonderful ways in which our donors and supporters help us to make a difference to the lives of those affected by a neuromuscular condition.

By agreeing to these Terms and Conditions, you are agreeing that you have read and understood our Privacy Policy.

GENERAL FUNDRAISING TERMS & CONDITIONS

Social media agreement

1. You must ensure that any content you upload onto the site and any social media posts related to the challenge (including photographs) is not obscene, offensive, defamatory or racist and does not breach any law or regulation or any intellectual property rights of a third party or any right or duty owed to a third party. This means that if any of the content you upload is copyright protected, you must obtain the
copyright owner’s written permission in order to use it. 

2. In the event that you become aware of any content which breaches any of the above rules, please notify us immediately.

3. You must not use the site to misrepresent your identity or affiliation with any person or organisation.

Fundraising guidelines

4. The activity/event must meet requirements of relevant laws and regulations of their state or territory. Each state and territory has different fundraising regulations and it is your responsibility to ensure you meet any obligations outlined in these regulations, including organisational permits, licences, insurance or authorities to fundraise where necessary, particularly for raffles and competitions. 5. Any fundraising activity/event with the purpose of raising funds to be donated to Muscular Dystrophy Association of NSW shall be conducted in the fundraisers’ name and is the sole responsibility of the fundraiser.

6. Muscular Dystrophy Association of NSW is not responsible for any fundraising activities/events undertaken by the fundraiser.

7. Fundraisers raising funds under the Muscular Dystrophy Association of NSW name are not permitted to raise funds for personal financial gain. All funds must be donated to Muscular Dystrophy Association of NSW at completion of activity/event, unless there has been an agreed upon percentage of funds to be shared with multiple charitable organisations.

8. Muscular Dystrophy Association of NSW is unable to take a coordination role in all these activities and does not become involved in soliciting prizes, organising publicity or media, providing goods or services to assist the fundraiser in the running of the activity/event.

9. You must send us any offline funds raised, along with a complete record of income and expenditure, supporting receipts and invoices within 28 days of the activity/event being completed.

10. Muscular Dystrophy Association of NSW can provide official receipts for all donations. Tax-deductible receipts can only be issued to people donating $2 or more. For a gift to be tax deductible, donors must not receive anything in return. Gifts that are not tax deductible include raffle tickets, entry to events, auctions, and the purchase of goods.

11. Muscular Dystrophy Association of NSW may give you permission to use its ‘in support of’ logo on promotional material, once that material has been approved by Muscular Dystrophy Association of NSW. Any printed material produced by the fundraiser which carries the ‘in support of’ Muscular Dystrophy Association of NSW logo must have prior approval from the Muscular Dystrophy Association of NSWoffice.

12. Muscular Dystrophy Association of NSW reserves the right to withdraw our support of the fundraising event or activity at any time if it appears there is a likelihood of the organiser failing to meet any of the above responsibilities and/ or not aligning with mdnsw mission, brand and values.
